As an authorized affiliate partner of FastIMM, you agree to abide by the terms and conditions contained in this Agreement. Please read the entire Agreement carefully before registering and promoting FastIMM as an affiliate partner.

Your sole purpose in participating in this program is to legitimately promote our website in order to earn commissions from memberships and products purchased by individuals referred to FastIMM through your own website or personal affiliate referral record.

By registering for the FastIMM Affiliate Partner Program (the “Program”), you accept this Agreement and its terms and conditions.

Approval or Rejection of Applications

We reserve the right, at our sole discretion, to approve or reject any affiliate partner program application. You shall have no legal recourse against us for the rejection of your affiliate partner program application.

Commissions

Commissions are settled on a monthly basis. For an affiliate partner to receive commissions, their affiliate referral account must remain active for at least 31 days.

You cannot refer yourself for commissions, nor will you earn commissions from your own account purchases.

Payments are only made for successfully completed transactions. Transactions resulting in chargebacks or refunds will not be paid.

Termination

Your affiliate partner application and status in the Program may be suspended or terminated for any of the following reasons:

• Improper advertising (false advertising, misleading hyperlinks, etc.).
• Sending spam (mass emails, mass newsgroup postings, etc.).
• Advertising on websites that contain or promote illegal activities.
• Failure to disclose the affiliate relationship for any qualifying promotional activities, in accordance with applicable FTC guidelines and regulations, or any applicable laws.
• Infringement of intellectual property rights. FastIMM reserves the right to require parties using FastIMM trademarks to enter into a licensing agreement.
• Offering rebates, coupons, or other promised kickbacks from your affiliate commissions as an incentive. However, adding bonuses or bundling other products with FastIMM products is acceptable.
• Self-referral, fraudulent transactions, suspected affiliate fraud.

In addition to the above, FastIMM reserves the right to terminate any affiliate account at any time for any violation of this Agreement or for no reason.

Affiliate Links

You may use graphic and text links on your website and in your emails. You may also promote the FastIMM website in online and offline classified ads, magazines, and newspapers.

You may use the graphics and text we provide, or create your own, as long as they comply with these terms and do not violate the provisions listed in the “Termination” section.

Coupon and Deal Sites

FastIMM occasionally offers coupons to select affiliate partners and newsletter subscribers. If you have not been pre-approved for a brand coupon, you will not be permitted to promote that coupon. The following terms apply to any affiliate promoting our deals or coupon-related products:

• Affiliates may not use misleading text on promotional links, buttons, or images to imply anything beyond the currently authorized offer for a specific affiliate.
• Affiliates may not bid on FastIMM coupons, FastIMM discounts, or other phrases implying available coupons.
• Affiliates may not generate pop-ups, iframes, or any actions to set affiliate cookies unless the user explicitly clicks a link clearly marked for a specific coupon or offer.
• Users must be able to see the coupon/offer details before an affiliate cookie is set.
• Affiliate websites must not display “click to see offers/coupons” when no offer is available. Affiliates with such text will be immediately removed from the Program.

Pay-Per-Click (PPC) Policy

PPC bidding is not permitted without prior written permission.

Liability

FastIMM shall not be liable for indirect or incidental damages (loss of revenue, commissions) resulting from affiliate tracking failure, loss of database files, or any intent to harm the Program and/or our website.

We make no express or implied warranties regarding the Program and/or the memberships or products sold by FastIMM. We do not represent that the operation of the Program will be error-free, and we are not responsible for any interruptions or errors.

Term of Agreement

The term of this Agreement begins when you accept the Program and ends when your affiliate account is terminated.

The terms and conditions of this Agreement may be modified by us at any time. If you are unable to accept any modification, your only option is to terminate your affiliate account. Your continued participation constitutes acceptance of any changes.

Indemnification

The affiliate partner shall indemnify and hold harmless FastIMM and its affiliates, officers, directors, employees, licensees, successors, and assigns from any liability, damages, fines, claims, costs, losses, and expenses (including reasonable legal fees) arising from claims related to this Agreement resulting from the affiliate partner’s negligence, misrepresentation, failure to disclose, or willful misconduct.

Electronic Signatures Effective

This Agreement is an electronic contract that establishes the legally binding terms of your participation in the FastIMM Affiliate Partner Program. Completing the FastIMM application process constitutes your acceptance of this Agreement and all terms and conditions contained or referenced herein. This action creates an electronic signature with the same legal force and effect as a handwritten signature.
